BRITISH COLUMBIA - The Federal Court of Canada has dismissed two applications that would have forced a judicial review of the Cheviot pit development at ELK VALLEY COAL's Cardinal River operation 30 km southeast of Sparwood. The Cheviot project was approved in 2000 following a thorough and lengthy environmental assessment process that spanned eight years. The Court determined that the federal Department of Fisheries and Oceans properly applied regulatory process to the project according to law and that Elk Valley Coal secured all necessary provincial mining and environmental approvals and complied with all regulatory requirements in the development of the project.

With the favourable court ruling, the way is clear to ramp up production from the Cheviot project to its planned rate of 2.8 million tonnes/year by the end of 2005.
