NUNAVUT - MIRAMAR HOPE BAY LTD. of Vancouver has been fined $100,000 in NUNAVUT TERRITORIAL COURT in Cambridge Bay for a violation of subsection 36(3) of the Fisheries Act resulting from a June 2004 spill of 19,000 L of diesel fuel into Windy Lake.

The company had entered a guilty plea to the charge on Jan. 15, 2007. The court accepted the guilty plea and stayed related charges against the Miramar Hope Bay and four related companies.

The penalty includes a fine of $10,000 and a payment of $90,000 to the Environmental Damages Fund. The fund, administered by ENVIRONMENT CANADA, serves as a special holding or trust account to manage funds received as compensation for environmental damage. The fund directs the money raised from fines toward future projects that contribute to the remediation of damage to the environment in a cost-effective way, and to deter other parties from causing damage in the future.

The Environmental Damages Fund was established to ensure that penalties paid by polluters are directly applied to cleanup operations. Learn more at www.EC.gc.ca/EDF-FDE.
